These Terms and Conditions ("Terms") govern your access to and use of the website www.singdilse.com, related platforms, programmes, auditions, and services operated by Nextera Production ("Company", "we", "us", or "our"), including the Sing Dil Se singing competition and SDS Originals. By accessing our website, registering for any programme, or making any payment, you agree to be bound by these Terms.



1. Acceptance of Terms

By visiting our website, submitting a registration, accepting a payment link, or participating in any Sing Dil Se programme, you acknowledge that you have read, understood, and agree to these Terms, our Privacy Policy, and Refund & Disclaimer Policy. If you do not agree, you must not use our services or make any payment. Continued use of our platform constitutes ongoing acceptance of these Terms as amended from time to time.



2. Definitions

In these Terms, unless the context otherwise requires:

  • "Company" / "Organizer" means Nextera Production, the entity operating Sing Dil Se and SDS Originals.
  • "Platform" means www.singdilse.com and all associated web pages, portals, and digital services.
  • "User" / "Participant" / "You" means any individual who accesses the Platform, registers for auditions, or uses our services.
  • "Sing Dil Se" means the digital singing competition and related programmes conducted by the Company.
  • "SDS Originals" means the original music production and artist launch vertical of Sing Dil Se.
  • "Shortlisted Participant" means a User whose application has been reviewed and approved by the Company for progression to paid stages of the programme.
  • "Payment Link" means a unique, individually issued URL or payment request sent by the Company to a Shortlisted Participant for authorised fee collection.
  • "Services" means auditions, studio recording, competition participation, music production, and related offerings provided by the Company.


3. Eligibility

Participation is open to individuals who meet the eligibility criteria specified for each programme season. By registering, you represent and warrant that:

  • You are at least 18 years of age, or if under 18, you have valid consent from a parent or legal guardian;
  • All information provided by you is true, accurate, and complete;
  • You are legally competent to enter into a binding agreement under the Indian Contract Act, 1872;
  • You have disclosed any ongoing criminal or civil proceedings or past convictions in writing at the time of application, where applicable;
  • You are not prohibited from using our Services under any applicable law.

The Company reserves the right to verify eligibility at any stage and to reject or disqualify any application that does not meet programme requirements.



4. Registration

Registration must be completed online through the official Platform only. Submission of a registration form does not guarantee selection, shortlisting, or participation in any paid stage of the programme.

The registration process includes: (a) online application submission; (b) review by our team; (c) shortlisting based on programme criteria; (d) issuance of an individual Payment Link to Shortlisted Participants; (e) payment confirmation; and (f) progression to recording or contest participation, as applicable.

Any discrepancy or mismatch in participant details at any stage may result in disqualification if not resolved to the Company's satisfaction. Participants must bring valid identity proof (PAN Card, Passport, Driving Licence, or Voter ID) and payment confirmation when attending studio or in-person sessions, where required.



5. Payment Link Business Model

The Company operates a verified, shortlist-based payment model in compliance with applicable Indian laws and payment gateway requirements:

  • Payments are accepted only from Shortlisted Participants after successful verification of their application;
  • Payment links are shared individually by the Company through official communication channels (email, SMS, WhatsApp, or other verified means) and are not publicly available on the website, social media, or any public forum;
  • Each Payment Link is unique to the recipient and must not be shared, forwarded, or used by any third party;
  • Users must not make payments through unofficial links, unauthorised representatives, or third-party agents claiming to act on behalf of Sing Dil Se or Nextera Production;
  • The Company shall not be responsible for any payment made through unauthorised channels.


6. Pricing

Fees, charges, and package prices are communicated individually to Shortlisted Participants at the time a Payment Link is issued. Unless otherwise stated in writing:

  • Studio recording and participation fees are as specified in the individual payment communication issued to you;
  • The standard studio recording fee for shortlisted studio round participants is INR 3,000 (Indian Rupees Three Thousand Only), unless a different amount is specified in your Payment Link;
  • All prices are quoted in Indian Rupees (INR) unless expressly stated otherwise;
  • The Company reserves the right to revise pricing for future programmes or seasons with prior notice, without affecting confirmed payments already received.


7. Taxes

All fees are exclusive of applicable taxes unless expressly stated otherwise. You are responsible for payment of all applicable taxes, including Goods and Services Tax (GST), as levied under the laws of India. Tax invoices shall be issued in accordance with applicable statutory requirements where applicable. The Company complies with applicable tax laws and payment settlement regulations as required by authorised payment aggregators and banking partners in India.



8. Refund

Unless expressly stated otherwise in writing or as required under applicable consumer protection laws:

  • Registration fees, studio recording fees, and programme participation fees are non-refundable once payment is confirmed;
  • No refund shall be issued for disqualification due to violation of these Terms, submission of false information, or failure to attend scheduled sessions without prior approved cancellation;
  • Refund requests, if any, shall be considered only in accordance with our Refund & Disclaimer Policy;
  • Approved refunds, where applicable, shall be processed to the original mode of payment within a reasonable timeframe subject to payment gateway and banking timelines.


9. Cancellation

The Company may cancel, postpone, or modify any audition, studio session, or programme event due to operational, technical, or force majeure reasons. In such cases, the Company will endeavour to reschedule affected sessions or provide alternative arrangements at its discretion.

Participants wishing to cancel their participation must notify the Company in writing at info@singdilse.com. Cancellation does not entitle the participant to a refund unless expressly approved by the Company in writing or as mandated by applicable law.



10. Intellectual Property

All content on the Platform — including logos, trademarks, text, graphics, audio, video, software, and design elements — is the property of Nextera Production or its licensors and is protected under applicable intellectual property laws of India. You may not copy, reproduce, distribute, modify, or create derivative works without prior written consent from the Company.

Participation in Sing Dil Se does not grant you any ownership rights in the Company's brand, platform, or proprietary materials.



11. SDS Originals

SDS Originals is the original music and artist launch division of Sing Dil Se. Content produced under SDS Originals — including original songs, music videos, and promotional materials — remains the intellectual property of Nextera Production and/or its assigned rights holders unless otherwise agreed in a separate written contract.

Selected artists may receive promotional exposure and distribution support subject to separate programme terms communicated at the time of selection. No entitlement to royalties, ownership, or commercial rights arises unless expressly provided in writing.



12. User Generated Content

By submitting audition videos, audio recordings, photographs, or any other content ("User Content") through the Platform, you grant the Company a non-exclusive, royalty-free, worldwide, sublicensable licence to use, reproduce, publish, broadcast, and distribute such content for programme purposes, marketing, and promotional activities related to Sing Dil Se and SDS Originals.

You represent that you own or have the necessary rights to submit User Content and that it does not infringe any third-party rights. The Company may remove any User Content that violates these Terms or applicable law.



13. User Obligations

You agree to:

  • Provide accurate and complete information during registration and throughout participation;
  • Maintain decorum at audition venues, studio sessions, and online interactions;
  • Follow all instructions issued by the Company and its authorised representatives;
  • Not spread false, misleading, or defamatory information about Sing Dil Se, Nextera Production, or its personnel;
  • Not engage in conduct that disrupts programme operations or harms other participants;
  • Not attempt to circumvent the shortlist-based payment process or use unauthorised payment channels.

Violation of these obligations may result in immediate disqualification and legal action where applicable.



14. Third Party Services

Our Platform may integrate or link to third-party services including payment gateways, social media platforms, and analytics providers. Your use of such services is governed by their respective terms and privacy policies. The Company is not responsible for the availability, accuracy, or practices of third-party services and disclaims liability arising from your interaction with them.

All online payments are processed through authorised payment aggregators compliant with RBI guidelines. The Company does not store complete payment card details on its servers.



15. Limitation of Liability

To the maximum extent permitted by applicable law, Nextera Production, its directors, employees, agents, contractors, and vendors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or participation in any programme.

The Company shall not be responsible for costs, injuries, losses, or damages arising from incomplete, lost, late, misdirected, or illegible submissions, or failure to receive submissions due to human error, transmission issues, or technical malfunctions beyond its reasonable control.

Total liability of the Company for any claim shall not exceed the amount paid by you to the Company in the twelve (12) months preceding the claim.



16. Indemnification

You agree to indemnify, defend, and hold harmless Nextera Production, its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your breach of these Terms; (b) your User Content; (c) your violation of any law or third-party rights; or (d) your misuse of the Platform or Services.



17. Force Majeure

The Company shall not be liable for any failure or delay in performance of its obligations due to events beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, government restrictions, war, civil unrest, strikes, power failures, internet or telecommunications outages, or failures of payment systems or third-party service providers.



18. Termination

The Company may suspend or terminate your access to the Platform and participation in any programme at any time, with or without notice, for violation of these Terms, fraudulent activity, or conduct detrimental to the programme. Upon termination, provisions relating to intellectual property, limitation of liability, indemnification, and governing law shall survive.



19. Privacy Policy

Your personal data is collected and processed in accordance with our Privacy Policy available at privacy_policy.html. By using our Services, you consent to such collection and processing. We implement reasonable security measures to protect your information; however, no electronic transmission is completely secure.



20. Disclaimer

The Platform and Services are provided on an "as is" and "as available" basis. The Company makes no warranties, express or implied, regarding uninterrupted access, accuracy of content, or suitability for any particular purpose. Participation in Sing Dil Se does not guarantee selection, fame, employment, recording contracts, or commercial success.

21. Modification of Terms

The Company reserves the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised "Last Updated" date. Your continued use of the Platform after such changes constitutes acceptance of the modified Terms. Material changes affecting payment or refund policies will be communicated through official channels where practicable.



22. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Applicable statutes including the Information Technology Act, 2000, Consumer Protection Act, 2019, Indian Contract Act, 1872, and applicable RBI/payment regulations shall apply to the extent relevant.



23. Jurisdiction

Subject to applicable law, any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts at Noida, Uttar Pradesh, India. You agree to submit to the personal jurisdiction of such courts for resolution of disputes.
